All employers face increased, substantial risk in fulfilling their fiduciary responsibilities regarding employee benefit plans – and financial services companies are no exception. Recent Supreme Court and other federal court rulings have raised the stakes, finding employers liable for substantial monetary damages and penalties. Risks abound: in communicating the nature of benefits or changes to benefits, properly documenting deliberations and determinations of a plan's committee, and general failings of, and inadequacies in, plan governance.
