In these challenging economic times, more and more employers are laying off employees in numbers not seen since the last recession. Learn about the rules that apply to economic layoffs and how to avoid liabilities that can be greater than the projected savings of downsizing. This session will discuss the issues and answer your questions relating to the selection of employees for lay-off, the drafting of enforceable releases, compliance with WARN state statutes, other state obligations, and ERISA.

We also will discuss how economic uncertainty magnifies the risks of union organizing in your workforce.  A key legislative proposal gaining momentum in Washington, D.C., known as the Employee Free Choice Act (EFCA), is advertised to increase job security, and raise employees' leverage against management generally, by making it easier for unions to organize new members.  EFCA would create an unmonitored card-check process to replace the tradition of NLRB conducted secret ballot elections that have been guaranteed for employees for more than 70 years.  EFCA could fundamentally change the way you do business by significantly increasing the risk of organizing in your workforce, reducing your opportunities to communicate with your employees, increasing the penalties for violating federal labor law during a union organizing drive, and lowering the prospects for achieving a successful labor agreement if your workforce is unionized.  Start preparing for dramatic changes in federal labor law now by learning about how EFCA will affect your workplace.
