As a federal government contractor, if you have not been audited in the last two years, or if you are new to the AAP/EEO role, you need to understand the fundamental shift that has occurred in the way OFCCP is auditing companies. Now, more than ever, contractors must perform analyses of their affirmative action data -- applicants, hires, promotions, terminations, and compensation -- before submitting any data to the OFCCP.

We will address the pressing, and often subtle, considerations that must be given to an audit submission and:

  • We will offer strategic guidance and review by experienced practitioners
  • Discuss why some companies may face substantial follow-up requests for information because initial submissions were not carefully prepared and were not fully vetted
  • Explain how OFCCP is enforcing the new definition of an Internet Applicant in audits
  • How companies should be evaluating compensation – both for an audit submission and as part of its annual self-evaluation obligation

Whether you are preparing the plans in-house yourself, or you are tasked with supervising the preparation of the plans by an outside consultant, you need to know where OFCCP is going before the audit notice arrives.

About the Presenters:

David Casey, Esq., (Moderator) is the Office Managing Shareholder of Littler Mendelson's Boston office. Mr. Casey counsels employers on a daily basis in many aspects of the employment relationship including litigation avoidance, terminations, diversity and safeguarding proprietary information.

Alissa A. Horvitz, Esq., Shareholder (Speaker), has prepared and defended hundreds of desk audit submissions. Since January 2003, not a single desk audit submission prepared by her and her team has closed with a conciliation agreement. All have closed with a Notice of Compliance. She has significant on-site defense experience preparing and defending managers in interviews, and in preparing employees for interviews. Ms. Horvitz speaks frequently to employer groups, including many local and regional Industry Liaison Groups, and will be speaking at this year's annual National Industry Liaison Group conference in New York City about using affirmative action plans appropriately and effectively in corporate diversity efforts.

Joshua S. Roffman, Esq., Of Counsel (Speaker), oversees the preparation of affirmative action plans and advises clients on OFCCP regulations (such as those on Internet applicant and compensation), EEO-1 and VETS-100 reporting requirements, whether a company is a federal government contractor, and OFCCP jurisdictional issues. He prepares dozens of desk audit submissions each year and has yet to have a desk audit submission close without a Notice of Compliance. He also prepares and defends clients in OFCCP on-site audits.
