This session is a part of a full-day conference.

The presentation will review practices that can lead to legal claims and how to avoid them, including misclassification (independent contractors who, functionally and legally are employees and employees classified as overtime-exempt who do not satisfy any exemption), overtime violations (such as not including incentive compensation in the hourly rate for overtime or refusing to pay for overtime when the hours were not authorized), improper deductions to pay (such as for breakage with an exempt employee or without a written authorization for a non-exempt employee), improperly denying pay at termination and the potential for treble damages (such as for used vacation without a written forfeiture policy or for incentive compensation when the law requires payment).
