Biography

Mr. Roffman’s practice primarily focuses on overseeing and advising clients on the preparation of affirmative action plans, and representing clients in various matters before the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP). Mr. Roffman is part of a team of attorneys and data analysts who prepare client affirmative action plans for a flat fee. Every affirmative action plan prepared by the team undergoes attorney review to ensure regulatory compliance, accuracy, and strategy, anticipating the larger legal implications of the information contained in the data analyses. Mr. Roffman and Littler’s Washington-based OFCCP team produce annually hundreds of client affirmative action plans.

In addition to overseeing the preparation of affirmative action plans, Mr. Roffman advises clients on OFCCP regulations (such as those on Internet Applicant and compensation), EEO-1 and VETS-100 reporting requirements, whether a company is a federal government contractor, and OFCCP jurisdictional issues and evaluates employment tests used by government contractors for conformance with the Uniform Guidelines on Employee Selection Procedures (UGESP).

Mr. Roffman prepares dozens of desk audit submissions each year. Over 98% of the desk audit submissions he has prepared have closed without an onsite visit by the OFCCP. He has had a similar success rate in closing audits without the issuance of a Notice of Violations. He has defended OFCCP on-site audits in every OFCCP region.

Mr. Roffman also has significant experience advising clients on reductions in force and preparing adverse impact analyses related to reductions in force, and he advises clients on the preparation of OWBPA disclosures. Mr. Roffman uses statistical and data analysis tools in other contexts as well—specifically, employer hiring decisions and applicant tracking, promotions, terminations, diversity initiatives, and compensation practices.

Mr. Roffman has spoken to several Industry Liaison Groups. He has conducted web seminars on preparing affirmative action plans and preparing OFCCP desk audit submissions, OFCCP’s systemic compensation initiative, analysis of employee selection decisions, and E-Verify regulations for federal contractors. He also has conducted employer training sessions on OFCCP’s Internet Applicant regulations and other affirmative action plan issues. He has co-authored two articles published by the Society for the Human Resources Management (SHRM) Legal Report on OFCCP enforcement initiatives and regulations.
