Massachusetts recently enacted a new law that severely restricts employers' ability to enter into enforceable noncompetition agreements with employees. The law, which is the product of years of negotiation, prohibits noncompetition agreements for many kinds of employees. In addition, the law imposes requirements that must be satisfied to enforce noncompetition agreements against other employees. However, if employers comply with these requirements, the new law suggests courts should enforce the agreements, taking away some of the uncertainty that has surrounded enforcement over the years. During this webinar we will discuss:

  • The impact of the new law on existing noncompetition agreements
  • How to address employees for whom employers can no longer impose noncompetes
  • Tips for drafting enforceable noncompetition agreements under the new law
  • Garden leaves, and the other forms of compensation employers may provide in order to satisfy the requirements of the law
  • Potential traps for the unwary
