Massachusetts Governor Charlie Baker recently signed into law an Act To Establish Pay Equity. The Act makes a number of sweeping changes to the law governing compensation in Massachusetts. The Act prohibits employers from asking job applicants about their salary history. In addition, the Act makes it unlawful for an employer to pay employees of different genders differently for performing comparable work – a term that is broadly defined and not limited to the same job title. Some of the requirements of this new law are unique in the country, and will provide significant challenges to employers operating in Massachusetts.
