Numerous headwinds are colliding in 2023 – and presenting employers with a litany of tough decisions.

Littler’s eleventh annual survey – completed by 515 in-house lawyers, C-suite executives and HR professionals based across the U.S. – offers insights for employers as they look to mitigate risks, seize new opportunities and lay the foundation for the future workplace.

The survey finds that the hybrid work model and the rise in employee requests for disability accommodations, especially for mental health conditions, are among the lasting effects of the COVID-19 pandemic. At the same time, many employers are bracing for heightened regulatory enforcement with pending leadership changes at key federal agencies and new laws proliferating at the state and local levels in such areas as paid sick and family leave, data privacy and pay equity. The survey findings also shed light on the myriad ways technology is reshaping the workplace, from use of employee-monitoring software to generative AI technology to AI tools in HR, posing new opportunities and challenges for employers.
