Feds caution employers about bonuses, pay structures in overtime compliance

Nicole LeFave and Brian Rho say a DOL opinion letter regarding certain performance-based bonuses and pre-shift “roll call” time in overtime calculations “reinforces a longstanding principle: if a bonus is promised in advance and triggered by conditions set by the employer, it must be included in the regular rate for overtime purposes.”
