Court Scuttles NLRB Recess Appointments Creating Uncertainties for Provider Employers

This article details how hundreds of decisions in the past year could be overturned because of the recent NLRB appointments being deemed unconstitutional. Littler’s Walter Hunter notes that the decision of NLRB recess appointments being unconstitutional is significant because they “issued a number of important precedent departing decisions” with some addressing issues “extremely important to healthcare employees”. Littler’s Alan Model agrees and believes the full importance of the decision will not be known for some time.
