Timothy S. Anderson

Timothy S. Anderson has successfully represented employers in state and federal courts, administrative agencies, and arbitrations across the country since 1999. Tim focuses on defending employers in complex wage and hour class, collective, and representative actions, as well as individual discrimination, harassment, and retaliation cases. With extensive experience litigating matters in more than 30 states, Tim represents employers in all aspects of wage and hour disputes, including claims involving overtime compensation, employee misclassification, off-the-clock work, travel time, boot-up time, regular rate disputes, incentive compensation, donning and doffing, rounding, meal and rest breaks, tip and gratuity practices, independent contractor classifications, wage statements, PAGA, and state-specific wage payment laws. In addition to representing employers in well over 100 wage and hour class, collective, and representative actions, Tim also has experience handling other types of complex litigation, including FCRA class actions, mass vaccination litigation, and equal pay cases. He focuses on developing strategic and practical solutions tailored to each client’s business objectives with a focus on unparalleled responsiveness and client communication.

• Defeating class certification in an assistant store manager misclassification case in California
• Defeating class certification in a FCRA class action in Oregon
• Obtaining summary judgment in an outside sales misclassification class and collective action in California
• Representing a manufacturer in mass vaccination litigation involving approximately 40 separate lawsuits scattered across more than 20 states and obtaining summary judgment rulings in a number of them
• Leading the defense of a large, nationwide collective action against a manufacturer in Ohio involving donning and doffing, rounding, and off-the-clock claims that resulted in a nuisance value settlement of the plaintiff’s individual claims
• Leading the defense of a nationwide rounding collective action against a manufacturer in Illinois, which resulted in a nuisance value settlement of individual claims
