Overview

As a member of the Littler CaseSmart – Charges™ team and based in New York, Joshua Marcus is responsible for handling charges from investigation to conclusion. He works on client-dedicated service teams, focusing on handling administrative agency charges. He investigates charge allegations, reviews pertinent documents, interviews key witnesses, and provides clients an assessment of the risks associated with the charge. In partnership with the client, he defends the charge by drafting persuasive position statements and responses to the agency’s requests for information.

Prior to joining Littler, Josh practiced labor and employment law for over twenty-three years including the last sixteen years as a partner of a boutique labor and employment firm located on Long Island, New York. In such capacity, he provided litigation and counseling advice to clients operating on a local, regional, and national level. His practice primarily focused on the litigation and counseling of harassment, discrimination, and wage and hour claims under state and federal law with a specific concentration on retail and hospitality clients. Josh regularly appeared before federal and state courts in New York and New Jersey in all aspects of litigation from inception through trial.

Josh has represented clients in numerous arbitrations and mediations in employment law and labor law matters. He has appeared numerous times on behalf of clients before federal state and local agencies including the Equal Employment Opportunity Commission, the New York State Division of Human Rights, the New Jersey Commission on Civil Rights, the United States Department of Labor, the New York State Department of Labor, the New Jersey Department of Labor and Workforce Development, as well as various other state agencies.

Josh has given many presentations before various networking and trade associations on Long Island regarding employment and labor law issues, including the Town of Huntington Chamber of Commerce, and Village of Northport Chamber of Commerce. He has also provided sexual harassment and antidiscrimination training sessions to numerous clients.
