Christine M. Fitzgerald
Christine M. Fitzgerald is an experienced litigator and legal advisor whose practice focuses on unfair competition, misappropriation of trade secrets, and related employee mobility matters. She represents employers in disputes involving the alleged theft, misuse, or disclosure of confidential information and trade secrets, and regularly assists clients with internal investigations, computer forensic reviews, litigation strategy, and policies designed to protect proprietary business information. Christine also advises employers on proactive measures to safeguard confidential information, including employee agreements, internal protocols, policy development, and response strategies when sensitive information may have been taken or disseminated.
Christine also has significant experience defending employers in single-plaintiff litigation involving harassment, discrimination, retaliation, and wrongful termination claims, as well as wage and hour class and representative actions. She partners with clients on employee relations issues, including leaves of absence, performance management, discipline, and terminations.
Christine has successfully defended an employer at trial in a case involving harassment, discrimination, and wrongful termination claims, where the jury returned a complete defense verdict. She has also obtained complete defense arbitration awards and favorable outcomes for employers in state and federal court.
Before joining Littler, Christine served as an Assistant U.S. Attorney in the Civil Division of the U.S. Attorney’s Office for the Southern District of California, where she represented the United States and its agencies in employment discrimination, personal injury, bankruptcy, and other civil matters. She also clerked for the Hon. Scott C. Clarkson and the Hon. Mark D. Houle, U.S. Bankruptcy Judges for the Central District of California.
