How Glatt v. Fox Searchlight Pictures Impacts Intern Hiring Decisions in Entertainment and Other Industries

This program is designed for company executives who make hiring decisions on interns.

Speakers will discuss how the mere labeling of a worker as an intern is not enough protection against wage and hour laws.

The recent Glatt v. Fox Searchlight Pictures decision threatens the future of internships with the growing trend of class-action lawsuits by unpaid interns against their employers. In Glatt, the interns performed administrative office duties for a production company that incorporated to create the film "Black Swan." The federal court ruled that the interns were employees entitled to wages under the Fair Labor Standards Act and New York labor laws. The court also determined that Fox Searchlight was a joint employer of the production company’s employees since it retained the authority to control key elements of the work relationship.

Learn the rules to protect your hiring practices:

  • The Rules – What determines whether an individual qualifies as an unpaid intern?
  • Interpreting the Rules – What do the rules actually mean?
  • Applying the Rules – What type of work can bona fide unpaid interns do and not do?
  • Mitigation for Possible Noncompliance with the Rules – Advice to minimize potential exposure to wage and hour claims by current, recent or prospective unpaid interns.
  • Avoiding Need to Comply with the Rules – Cost-effective alternatives to unpaid interns to avoid possible wage and hour, whistle-blower, retaliation, other employment-related claims.
