The homecare industry is undergoing rapid consolidation and unprecedented change. This program will explore employment law issues that arise in corporate mergers and acquisitions, from both the buyer’s and seller’s point of view. We will specifically focus on issues that are unique to the homecare industry and that can kill deals or result in significant buyer’s remorse. Topics we will address include:
- WARN Act compliance
- Wage and hour and other employment law due diligence red flags/deal killers
- Related provisions in asset purchase agreements
- Key employee, retention, and severance agreements
