The civil components of Minnesota’s new Wage Theft Law become effective July 1, 2019, creating new requirements and compliance challenges for all employers. For example, the law:

  • Requires a detailed wage notice to be provided to all employees hired on or after July 1, 2019
  • Requires new information to be included in earnings statements
  • Requires that commissions be paid at least once every three months
  • Requires employers to describe and retain a record of all policies distributed to an employee
  • Adds anti-retaliation provisions
  • Changes the potential penalties for failure to timely pay wages and for recordkeeping violations
  • Creates criminal penalties for certain violations of the law

Despite the significance of some of the changes, to date, the Minnesota Department of Labor and Industry has provided limited guidance to employers. As with any new law, there are a number of unanswered questions and practical considerations that we will be addressing in this 60 minute presentation.
