The compliance bar for local leave laws just got significantly higher. With the February 2026 expansion of the Earned Safe and Sick Time Act (ESSTA), New York City has established a complex new standard that serves as a blueprint for regulators across the country. Littler shareholders Stephen Fuchs and Sanjay Nair will present an in-depth analysis of NYC's new requirements and a strategic discussion on what these developments signal for employers nationwide.

What we will cover:

  • The Immediate Availability Shift: We will break down the mechanics of NYC's new requirement for 32 hours of unpaid sick leave. Unlike traditional leave, which typically accrues over time, this leave is now immediately available to part-time employees and mid-year hires. We will discuss the administrative challenges of "front-loading" leave and how to integrate this with existing Paid Time Off (PTO) policies to maintain compliance without overextending benefits.
     
  • Expanding the Definition of Care: NYC has introduced new covered uses for sick leave that extend far beyond illness. Employees can now use protected time to care for children or care recipients during school holidays, daycare closures or even babysitter cancellations. We will examine how these "life happens" provisions are expanding the scope of leave laws and how employers can verify such requests without running afoul of privacy or anti-retaliation rules.
     
  • The National Signal and Strategic Takeaways: NYC is often the testing ground for labor laws that eventually migrate to other jurisdictions. We will include a forward-looking perspective of legislative trends in other states and implications for multi-state employers.
