The IRS has recently sent a flurry of assessment notices to employers for failure to provide coverage as required under the ACA. In many cases the assessments have been over a million dollars. We will examine the principal reasons for the assessments and the defenses that employers may assert in response to the IRS assessment.

In response to an executive order of last October, the Department of Labor has issued a proposed rule regarding the formation of Association Health Plans (AHPs) with the intention of allowing small businesses with a commonality of interest to join together in an association to sponsor large group health plans. The Department has asked for comments on its proposed rule with respect to how broadly it should define commonality of interest for purposes of an AHP, the authority of the DOL to pre-empt state MEWA regulations for AHPs and other aspects of the proposed rule. We will examine the possible creation of Association Health Plans on both an insured and self-funded basis and the potential financial savings to be derived by employers.
