Balancing Title IX Compliance with CBA Enforcement

Wednesday, April 8, 2026

Higher education institutions with unionized employees must navigate compliance with both Title IX and their collective bargaining agreements (CBA). In a recent decision from the New Jersey Supreme Court, Rutgers v. AFSCME Local 888, the Court refused to enforce CBA grievance procedures that conflicted with Title IX requirements. Littler higher education attorneys James Thelen, Valerie Jackson, Lauren Peach and Eliza Kaye will review this decision and related issues and lead a discussion about the practical implications for higher education institutions and their CBAs.
