The January 1, 2018 effective date for the new New York Paid Family Leave Benefits Law is fast approaching. This law will bring sweeping changes to employee leave and benefit entitlements in New York. Final regulations implementing the new law were adopted on July 19, 2017, and provide additional guidance on several components of the new law, including:

  • Coverage issues regarding full-time and part-time employees
  • The use of intermittent leave
  • Calculation of the rate for weekly and daily leave
  • Coordination with FMLA leave, including when FMLA leave (or paid time off) can be counted against paid family leave
  • Obligations regarding employee handbooks and notice posting
