Supreme Court ruling tightens causation rules for retaliation

In an article on University of Texas Southwestern Medical Center v. Nassar, Littler’s Gregory Keating discusses the U.S. Supreme Court’s ruling as a victory for employers that will make it more difficult for plaintiffs to prove retaliation. He notes that the court “adopted a very strict test” for establishing causation, which represents a shift from other recent court decisions that made retaliation easier to establish.
