Trump’s DOL proposes unwinding independent contractor test
As DOL prepares to roll back a Biden-era rule defining who is an independent contractor, Michael Gotzler says determining how a worker can or should be classified has become increasingly challenging for employers due to the dozens, if not hundreds, of federal, state and local employment laws and regulations, which all have a differing definition of independent contractor and a different test for making that determination.
