Littler's Neil Alexander is quoted on this article discussing the new federal rules on document retention, and how they will cost employers. "You have an affirmative obligation to preserve evidence once you know a potential claim is going to be filed," says Alexander. But he also notes that the rules may increase the possibility of unfair competition and theft of data. "When you receive one of these warnings it can be very expensive," said Alexander.
