In light of the possible EFCA enactment and the threat that it poses, companies are taking proactive measures to prevent their employees from resorting to union formation, including embracing union-friendly practices. "If an employer is considering grievance and arbitration procedures, it ought to be because it makes operational sense. It should not be to influence any employee's decision on whether or not to organize," said Bob Battista of Littler's Washington, D.C. office.
