Anna Mary Gannon Warns Employers of the New E-Discovery Risks

In this California Lawyer 8-K Roundtable discussion, Littler's AnnaMary Gannon discusses the steps of e-discovery process, and why it is evolving as an industry. "Even before we get to the Meet and Confer process," says Gannon, "the client and the attorney have to get educated about the client's electronic data, just as you mentioned—what they have, what format, whether they keep back-up tapes, and where they keep them. You need to have both counsel and IT representatives sitting at the table long before counsel is going to be talking to opposing counsel about electronic discovery. So the very first step is to sit down and say, 'What do you have?'"
