6th Circ. Tosses Nurse's Lunch Pay Suit As Time-Barred

This article discusses the Sixth Circuit upholding of a decision to toss a former nurse’s collective action against Baptist Memorial Hospital Inc. over lunch break pay deductions, finding that he had failed to file a required consent form before the statute of limitations expired. Littler shareholder Paul Prather, attorney for Baptist Memorial, said Tuesday that the hospital was pleased with the decision, noting that the Sixth Circuit’s decision to uphold summary judgment was based on the plain language of the statute and therefore not surprising.
