Rachel Werner represents, counsels and trains management clients in a broad range of employment matters arising under federal and state law, including discrimination, harassment, retaliation, wrongful termination, leave and accommodation, and wage and hour issues. In addition to her focus on single plaintiff litigation, she also has extensive experience with California class action and complex litigation matters. Her class action experience includes opposing class certification, successfully compelling arbitration and obtaining dismissals at the motion-to-dismiss stage.

Rachel routinely partners with HR and business leaders by providing advice and counsel on a wide range of issues, such as performance management, contract negotiations, preparation of retention and separation agreements, and settlement negotiations.

Additionally, she is regularly invited to speak with HR and business leaders on topics that include the ADA, the FMLA, Title VII, wage and hour issues, creating a respectful workplace, and the essentials of good management.

Prior to joining Littler, Rachel practiced at a mid-sized Phoenix law firm, concentrating on general liability and employment matters.

During law school, she earned an oral advocacy award, served as a summer associate at a Phoenix firm and worked as a legal intern at the Mayo Clinic, where she helped develop a toolkit for employer guidance on how best to handle gender transition issues in the workplace.
