Jessica N. Wimsatt regularly counsels and represents employers with issues involving labor and employment laws.
Before joining Littler, Jessica worked at a plaintiff-side employment firm, where she handled discrimination, harassment, and retaliation litigation. This included causes of action in Title VII, Kentucky Civil Rights Act (KCRA), Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act (Rehab Act), Age Discrimination in Employment Act (ADEA), and the Family and Medical Leave Act (FMLA).
She has experience with the Fair Labor Standards Act (FLSA) and the Kentucky Wage and Hour Act, including employee classification and wage and hour disputes. Jessica's background also includes negligent hiring and supervision claims. She has advised clients on drug-testing policies, drafted independent contractor agreements, and reviewed handbook provisions.
Jessica has notable experience in constitutional and civil rights litigation (42 USC 1983), primarily regarding: a) free speech/First Amendment; b) unlawful search and seizure/Fourth Amendment; c) cruel and unusual punishment/Eighth Amendment; and d) due process violations/Fifth and Fourteenth Amendments.
