This program will briefly review recent New York State employment law developments, including:

Expanded workplace discrimination/harassment protections, including:

  • Expansion of coverage and protections (including to contractors)
  • Lower burdens of proof for complainants
  • Availability of punitive damages and attorneys' fees
  • Restrictions on the use of nondisclosure agreements (NDAs) for discrimination cases
  • Restrictions on the use of mandatory arbitration provisions
  • Extensions of the statute of limitations for sexual harassment claims

New pay equity requirements, including:

  • Expansion of relevant definitions and protected groups
  • Permissible factors for wage differentials and related requirements
  • Salary history ban (state-wide)

The information covered will benefit all New York employers, regardless of size, industry or geography.
