If recent headlines are any indication, immigration is one of the most politically charged areas of employment law today. In fact, ICE has initiated a strategic shift in the way it approaches employers by bringing criminal charges against them and seizing their assets. This is a shift from the old tactic of administrative fines as sanctions. ICE has received increased funding and personnel to handle enforcement actions, which usually begins with the I-9 audit. In this climate, your ability to verify that employees in your company are legally authorized to work in the U.S. is of crucial importance.

Deceptively straightforward, the I-9 form contains dozens of traps for the unsuspecting HR professional. Timing deadlines, detailed documentation restrictions, record-keeping requirements, and anti-discrimination rules all must be followed to the letter. These days, I-9 mistakes can even result in criminal liability. Even preliminary issues including which employees need an 1-9 raise serious questions for employers.
