The 2009-10 Legislative & Case Law Update

This Briefing will include a review of the legislation signed into law at the federal and state level, which will impact California employers in 2010 and beyond, including, but not limited to: the latest FMLA amendments providing new leave rights for the families of service members and the status of the EEOC draft regulations implementing the ADA Amendments Act of 2008 (ADAAA), which will amend the Americans with Disabilities Act of 1990 (ADA). There will also be an overview of EEOC guidance issued during 2009 that all employers should be aware of during 2010.
The Briefing will include a review of the most relevant California and Federal case law developments during the past year and how they will impact California employers.
A partial list of the topics to be covered includes:
Case Law Review: Review of the most significant 2010 federal and state court decisions impacting employers in the areas of wage and hour, leaves of absence, disability, discrimination, retaliation, wrongful discharge and other areas of employment law.
Wage and Hour: An update of the current status of California rest and meal period issues in light of the California Supreme Court 's review of the Brinker and Brinkley decisions. Review of legislative changes to the alternative work schedule rules; an overview of other recent wage and hour issues and recent DLSE guidance will be addressed as a part of this update.
The DHS's Decision to Rescind the No-Match SSN Rule and Impact on Immigration Issues: The Obama administration DHS has changed the focus of immigration enforcement in the workplace, which included rescinding the DHS’s no-match regulations. The impact of this decision on employers will be examined, including what you should do if a question arises regarding an applicant or employee’s authorization to work.
Leave of Absence Issues – the FMLA Regulations – Impact of the Most Recent Amendments and Recent Court Decisions: A review of the impact of the comprehensive DOL regulations that took effective January 16, 2009 and the most recent FMLA amendments.
Sexual Harassment: Review of recent decisions that should be addressed in your AB 1825 supervisor harassment training.
Suggested Employee Handbook Updates: A part of this session will include practical advice regarding the impact of various regulations and decisions on the updating of your current employee handbook policies.
PDFs of Recent Guidance: There will be an opportunity for those who attend to request various documents to be emailed to them. For example, the latest EEOC poster incorporating the Genetic Information Nondiscrimination Act (GINA) requirements, and others.
