The National Labor Relations Board (NLRB) recently published two new final rules that clarify its definition of “joint employer" and modify the procedures and guidelines for representation elections. The rules go into effect on April 27, 2020, and April 16, 2020, respectively. NLRB Chairman John Ring, members of Littler's D.C. office and Littler's Workplace Policy Institute (WPI) Co-chair Michael Lotito will discuss these rules and other developments as we head closer to the November elections.

Topics to be addressed include:

  • Developments that led to the formation of the new final rules
  • Factors that can and cannot be used to determine joint employer status under the new rule
  • The impact on existing joint employment arrangements
  • Highlights of the new election process

Additionally, the briefing will conclude with a quick update from Littler on a range of labor and employment topics currently impacting employers across the country.
