Incentive plans can create a minefield of issues from a compliance perspective. This program will provide an overview of common areas of dispute and noncompliance. We will discuss key areas of sensitivity and suggested strategies for response. Specific issues to be addressed will include:

  • Faulty “earning” language
  • The risks of paying hunter-like salespersons on revenue as it is received
  • Legal challenges to implementing clawbacks for reversed sales and repayment of incentive compensation, including pay statement penalties litigation
  • Recent attacks on “must be present to win” sales incentive clauses
  • The inside-sales misclassification dilemma
  • Whether incentives can be credited toward mandatory pay for rest breaks and other nonproductive time
