Historically, Virginia has had very few state-specific wage and hour laws, which helped make it a very welcoming jurisdiction for employers. But since 2020, that has all changed. The last several years have seen the Commonwealth enact all manner of new employee-friendly laws, including provisions that increased the state’s minimum wage, dramatically expanded employees’ ability to bring actions for untimely or unpaid wages, and enacted the state’s first standalone overtime obligations. While overlooked by many, these changes have significantly altered the legal landscape for employers in the Old Dominion and present the possibility of substantial liabilities for the unwary. This presentation will discuss this new generation of wage and hour laws, the challenges they pose, and what your organization should be doing to address this legal revolution.
