Recent efforts to prohibit the use of noncompete agreements for low-wage workers and nondisclosure agreements to silence sexual harassment allegations have put a spotlight on the viability of these post-employment business restrictions. In light of this heightened scrutiny, this presentation will explore recommended practices for drafting noncompete and nonsolicitation agreements to maximize enforceability and protect proprietary information and customer relationships. In addition, we will discuss steps employers can take to reduce risks associated with hiring employees who have restrictive covenants with their previous employer.
