Three major developments in the European Union in three consecutive months have resulted in tectonic shifts in EU data protection law, raising tough and significant questions for U.S. multinationals that transfer EU employees’ personal data to the U.S. First, the EU’s new data protection framework, the General Data Protection Regulation, was finalized in May. The U.K. Brexit vote in June to leave the EU added more uncertainty to the scene. Then in July, the European Commission determined that European companies can rely on the Privacy Shield Framework to transfer personal data to the U.S., and EU regulators then made their own announcement questioning the Privacy Shield’s efficacy. These stunning and confounding developments have left many U.S. multinational employers asking themselves, “What's next?”
