This presentation will walk you through the employer requirements under the New York Health and Essential Rights Act, or NY HERO Act, which amends the New York Labor Law (NYLL) by adding two new sections in an effort to prevent occupational exposure to an airborne infectious disease. The law was passed on May 5, 2021 and was followed by technical amendments and the issuance by the NY DOL of model safety plans. Deadlines for compliance are quickly approaching. Section 1 of the Act requires that employers adopt model safety plans no later than August 5, 2021 and must post and distribute the plan to employees within 30 days of adoption. Section 2 requires certain employers to allow employees to establish joint workplace safety committees with their employees by November 1, 2021. The law also prohibits discrimination and retaliation against any employees who exercise their rights under the NY HERO Act. We will review the new law, the amendments and employer requirements for compliance and walk you through model safety plans.
