A federal judge recently granted Littler's motions to vacate the DOL rule that would have prevented third-party employers from availing themselves of the companionship and live-in exemptions from minimum wage and/or overtime and that would have narrowed the definition of "companionship services" exempt from minimum wage and overtime under the Fair Labor Standards Act. Consequently, the Court effectively blocked all of the DOL's attempts to eliminate the minimum wage and overtime exemptions for home care aides. The DOL has appealed these decisions, and in the interim, the home care industry is in need of guidance concerning how to properly compensate home care employees.

Our speakers will provide a status report on what has occurred in the litigation thus far and provide practical next steps for home care employers in the wake of these decisions. Maury currently serves as lead counsel for the coalition of home care providers that filed the successful lawsuit against the DOL. Angelo is a leading practitioner in the health care field, advising numerous home care clients on compliance issues under the new rule.
