A New Generation of Regulation A Practical Perspective: ADAAA Final Regulations and the FMLA

The EEOC has taken the view that compliance efforts will no longer be stymied by challenges to coverage under the ADA – and employees and applicants have gotten the message. In 2010, the largest number of disability-related charges were filed with the EEOC since the enactment of the ADA. From FY 2008 to FY 2010, disability-related charges increased by 23% from 19,453 (FY 2008) to 25,165 (FY 2010). The EEOC also is carefully reviewing employer compliance efforts and has increased its litigation docket involving ADA litigation.
This program will highlight the most pressing compliance issues under the ADA for employers—including the often complicated overlap of the ADA and FMLA—and provide practical recommendations for handling those issues. Some of the key topics to be addressed include:
- What the final ADAAA regulations mean for employers, and how they change the focus for future disability discrimination litigation;
- The key compliance issues under the ADA that every employer must know, and practical considerations for addressing them;
- What "reasonable" means when addressing accommodation issues;
- The anticipated future of enforcement efforts and litigation under the ADA.
- A quick primer on the FMLA in 2011 and where we are under the recent regulations; and
- The interaction of the ADA with an employer's leave policies and the FMLA – and what the EEOC is doing about both.
