Pennsylvania recently became the 24th state to legalize a comprehensive medical marijuana program. This dramatic change provides job protection for employees utilizing medical marijuana and requires employers to make accommodations for that use. However, when contrasted with marijuana’s continuing illegal status federally, it presents challenging issues for safety, unemployment compensation, and workers' compensation matters.

Littler Philadelphia Shareholder Ben Huggett will share insights and provide guidance to help employers avoid risk and liability regarding this complicated issue.

Topics will include:

  • Is a drug free workplace policy viable and enforceable in states with legalized medical marijuana legislation?
  • How do you avoid discriminatory practices and claims when it comes to medicinal marijuana?
  • How and when can employers screen for impairment on the job?
  • What liability exists if an employee is injured or injures another on the job, while under treatment with medicinal marijuana?
  • What involvement does a union have with medical marijuana?
  • How are OSHA safety programs and injury and illness recordkeeping affected?
