In 2012, the EEOC issued updated guidance on criminal background checks that has a significant impact on the employer community. In December, the EEOC also approved a new Strategic Enforcement Plan highlighting the Commission's increased focus on systematic investigations and new priorities for 2013 and beyond. Additionally, the EEOC is taking the Seventh Circuit's new stance on employer obligations to provide disability accommodation very seriously. With all of these changes, we are seeing a new EEOC engaging in more detailed and exhaustive investigations. This increased focus means new burdens on employers.

In this session we will address:

  • Critical components of the EEOC's new guidance and Strategic Enforcement Plan
  • New case law in the Seventh Circuit affecting EEOC investigations
  • The EEOC process from filing to litigation
  • Practical tips for dealing with the EEOC during an investigation
