This special session is to discuss an important update in the lawsuit brought by the State of New York challenging the U.S. Department of Labor’s Final Rule implementing the FFCRA’s paid leave provisions – the Emergency Family and Medical Leave Expansion Act (EFMLEA) and the Emergency Paid Sick Leave Act (EPSLA).

On Monday August 3rd, the United States District Court of the Southern District of New York issued a decision vacating the provisions of the Final Rule related to the “work-availability” requirement, the definition of “health care provider,” the requirement that an employee secure employer consent for intermittent leave, and the requirement that an employee provide certain documents before taking leave.
