The trend in legislation aimed at holding multinational companies legally liable for their own human rights practices as well as those of business partners that may be involved in their supply or value chains is evident internationally.

Alongside the UK, France, the Netherlands and Norway, Germany is the next European country to add its legislative efforts to the already existing patchwork of similar laws. Moreover, the European Commission adopted on February 23, 2022, a proposal for a Directive on Corporate Sustainability Due Diligence. The proposed legislation goes beyond the German Supply Chain Due Diligence Act and therefore needs to be considered in this context additionally.

Not only companies based in Germany are affected – companies with subsidiaries and offices in Germany are obliged to comply with the obligations the German Supply Chain Due Diligence Act imposes on businesses as well.
