The Hot Zone: FLSA Collective Actions in Florida

Since December 2007, over 4,600 actions have been filed in Florida asserting claims under the Fair Labor Standards Act. Please join the attorneys of Littler Mendelson, who will share real-life case studies and reveal strategies and tactics that they have used to effectively minimize the risk of wage and hour collective actions. Topics will include an overview of recent litigation, mediation/settlement strategies, compliance tools, and methods of successfully defending against costly and potentially devastating litigation under the FLSA.
PROPOSED AGENDA
OPEN SESSION —
State of the State: An overview of recent trends in FLSA Class Actions in Florida, including the rate and locations of cases filed, claims asserted, lawyers involved, and an overview of how these claims are being treated by the courts.
Employer’s Obligations: A review of the major requirements the FLSA imposes on employers, with particular attention to the Act’s exemptions and what constitutes compensable work-time.
BREAKOUT SESSION — Compliance
Littler’s Total Compliance Initiative: A discussion of the compliance tools created by Littler Mendelson and a demonstration of how they can assist in complying with the FLSA.
BREAKOUT SESSION — Litigation
Litigating FLSA cases: Discussion of class certification, discovery, strategy, motions, jury instructions, etc. involved in litigating an off-the clock case.
Mediating and Settling FLSA cases: Selecting mediators, preparing for mediation, and potential terms of settlement, including injunctive and monetary relief.
Continuing Legal Education (CLE) credit approval pending. We will provide SPHR credit. There is no charge for this program.
