Prior to the COVID-19 pandemic, rates of substance abuse were climbing. These rates increased dramatically after the start of the pandemic. Studies show that one-third of Americans have reported increased alcohol consumption since the start of the COVID-19 pandemic, and 29% of drug users reported increased drug use during the same period.

Home Health Care employees have been disproportionately impacted by the pandemic, and as a result they remain at high risk for substance abuse, including opioid abuse which has skyrocketed over the last few years. And identifying drug or alcohol impairment is particularly challenging in home health care given the dispersion of the workforce. At the same time, employers remain obligated to provide employees with a safe workplace and address any physical hazards caused by drug or alcohol impairment. All of these factors have combined to create a perfect storm for employers in the home health care industry.

This interactive presentation will address these challenges and provide practical advice on mitigating the risk of disability discrimination claims and managing FMLA leave.​
