On the heels of the failed Employee Free Choice Act, the National Labor Relations Board and U.S. Department of Labor are pursuing by administrative fiat what organized labor has not achieved in Congress. In short, the rule changes proposed by these two agencies will substantially limit the ability of an employer to exercise its free speech rights and respond to union organizing efforts, and to be confident that its responses are consistent with the law.

  • Rule changes proposed by the NLRB would substantially expedite the representation election process and condense the time in which employers can respond to union communications and inform employees about what the election is about.
  • Changes proposed by the DOL to the advice rules will significantly interfere with an employer’s normally unfettered access to legal counsel, both internal and external, for advice and guidance.

These proposed rules are game-changers, and employers have sounded the alarm — evidenced by more than 60,000 comments submitted to the Board as of the August 22 closing date for filing initial comments.

In addition, we will highlight the NLRB's latest rulings and their implications for employers.
