Littler Mendelson invites you to join us for a focused breakfast briefing on Tuesday, January 15 to review important new legislative developments and legal trends that every California employer must know to ensure compliance and prevent liability in 2008. Highlights of the seminar include:
Wage and Hour: The California Supreme Court's 2007 landmark cases addressing the following critical issues:
- The status of meal and rest periods
- The payment of bonuses or other incentive compensation
- Review of other developments, including the minimum wage increase and other DLSE and court guidance on wage and hour developments
Disability Discrimination: The impact of the recent California Supreme Court 2007 decision holding that the "employee" has the burden of proof in establishing they can do the "essential functions of a job." A review of other recent cases impacting employers, including the interaction between the "disability" laws and use of Family Medical Leave.
Leave of Absence and FMLA Decisions: Review of recent court decisions, including what an employer's obligations are to an employee that is provided "light duty;" when an employer is on "notice" of the need for a leave; what constitutes "hours worked" for eligibility purposes; satisfactory "paperwork" substantiating the need for a leave, etc.
