As the media focus our attention on data security breaches by retailers and their customers' corresponding exposure to identity theft, Massachusetts has recently joined 38 other states in enacting legislation mandating that businesses in possession of personal information — including information about employees — notify those affected by a security breach. Massachusetts also has joined more than two dozen other states in enacting data protection legislation which applies to personnel records containing employee social security numbers, driver’s license numbers or financial account numbers, i.e., personnel information maintained by virtually all employers.

These new laws should be a call to action for all Massachusetts employers, particularly those with multi-state operations. As too many companies have learned, one lost laptop or a misdirected e-mail containing employees' social security numbers can lead to unflattering news stories, breed distrust by employees, and expose the employer to costly litigation.

Philip Gordon, Littler Mendelson shareholder, and special guest speaker, Dennis Hoffman, Vice President and General Manager, Data Security and Chief Strategy Officer at RSA, will present these new laws. During this program, we will update you on what these various state laws require and help you begin to develop an action plan designed to reduce the risk of a security breach and to respond efficiently, effectively and in compliance with these new notice laws when one does occur.
