Employers continue to struggle with knowing how best to satisfy their legal obligations towards employees with medical conditions. The Family and Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), state leave laws, workers compensation …. what applies when, and how?

This session will examine precisely what the ADA requires and how to satisfy those requirements, keeping in mind both business needs and an employer’s interest in reducing risk. Discussion will cover business-minded approaches towards providing accommodations and participating in the required interactive process, including how to evaluate an employee’s requested accommodation and how to document the interactive process. The speakers will review the current state of the law regarding leave as an accommodation, pregnancy under the ADA, light duty issues, and how the Family and Medical Leave Act and the ADA interact.
