Claims of ADA violations filed with the EEOC have risen 60% in the last four years. The ADAAA's expanded definition of who is "disabled" will likely result in this trend continuing. Adding this to an even more restrictive set of requirements under California disability law means that correctly managing the reasonable accommodation process required by such laws is even more critical than ever.

This highly interactive session is designed to equip you with the tools you need to meet this new and continuing reality. We will devote the entire session to analyzing elaborate and complex case studies culled from actual situations dealing with accommodation and other issues, including:

  • When and how to conduct the “interactive process” to determine possible reasonable accommodation
  • Whether an employer has to accommodate by providing intermittent leave after FMLA and other required leave options are exhausted
  • Accommodations for the difficult cases created by psychiatric disabilities
  • Working from home as an accommodation
  • Accommodation issues related to extended leave beyond FMLA and other mandated leaves
  • Issues regarding when medical exams can be done and employee compliance with medical treatment
  • Integrating the reasonable accommodation process with processes related to managing persons with work related injuries or disabilities

Our panelists have substantial experience concerning disability discrimination in the workplace and will work closely with attendees to discuss and develop practical solutions to problems raised in the case studies. Emphasizing best practices, participants will leave with a better understanding of how to deal with state and federal disability discrimination laws and accommodation issues in real life.
